General booking terms
Kuganha reserves the right of admission.
All reservations, amendments and cancellations are only effective once confirmed in writing by Kuganha.
Guests are strongly encouraged to obtain comprehensive travel insurance covering cancellation, curtailment, medical emergencies, personal belongings and unforeseen travel disruptions.
A valid government-issued identification document or passport must be presented upon arrival.
Should a reservation not be taken up, Kuganha reserves the right to apply the relevant cancellation fees and release any accommodation held where deposits or payments have not been received by the applicable due dates.
Deposit requirements may vary during peak travel periods, exclusive-use reservations and special events.
No refunds will be granted for late arrivals, early departures, missed activities or services not utilised during a stay.
Any applicable refunds remain subject to banking, administrative and commission charges.
Kuganha reserves the right to correct any inadvertent errors relating to rates, descriptions, promotional material or website content. In the unlikely event that an error affects a reservation, Kuganha reserves the right to amend or cancel the booking and refund persons without further liability.
Promotional offers and special rates are subject to availability and may not be combined with any other offer unless otherwise stated.
Exclusive-use reservations may be subject to separate booking terms, payment schedules and cancellation conditions, which will be communicated at the time of booking.
Cancellation policy
All cancellations must be submitted in writing and will only be effective once a written confirmation receipt has been issued by Kuganha.
Due to the exclusive and limited-inventory nature of Kuganha Luxury Tented Camp, the following cancellation terms shall apply to all confirmed reservations unless otherwise agreed in writing:
- Cancellations made 121 days or more prior to arrival: 5% of administrative fee will be charged.
- Cancellations made 120-91 days prior to arrival: 25% of the full booking value will be charged.
- Cancellations made 90-61 days prior to arrival: 50% of the full booking value will be charged.
- Cancellations made 60 days or less prior to arrival: 100% of the full booking value will be charged.
- No-shows, late arrivals, or unused services: 100% of the full booking value will be charged.
Wildlife and activity risk acknowledgement
Kuganha is situated within a Big Five private wildlife reserve where guests may encounter free-roaming wildlife and participate in outdoor experiences.
Nature encounters, guided activities and wildlife viewing experiences are undertaken with an understanding of the inherent risks associated with natural environments.
Guests are required to follow all guidance and safety instructions provided by guides, hosts and staff members. Kuganha reserves the right to restrict participation in any activity where guest conduct may compromise safety.
Nature encounters are shaped by wildlife movement, environmental conditions and seasonal rhythms. Specific sightings and experiences cannot be guaranteed.
Wildlife sightings are dependent on natural animal behaviour and environmental conditions. While every effort is made to provide meaningful nature encounters, specific sightings shall not constitute grounds for refund or compensation.
For reasons of safety, conservation or operational necessity, Kuganha reserves the right to modify, postpone or cancel activities without prior notice.
Restoration facility disclaimer
The restoration facilities and experiences available at Kuganha are designed to support rest, wellbeing and personal restoration.
They are not intended as medical treatments and should not be relied upon as a substitute for professional medical advice, diagnosis or treatment.
Guests are responsible for informing Kuganha of any relevant medical conditions, injuries, allergies, pregnancies or health concerns that may affect participation in restoration experiences.
Access to certain facilities or experiences may be limited where participation may pose a health or safety risk.
Guests use all restoration facilities at their own discretion and are responsible for ensuring that participation is appropriate for their individual health and physical condition.
Liability
While every reasonable effort is made to ensure guest comfort and safety, Kuganha, its employees, representatives, contractors and affiliates shall not be held liable for any injury, illness, loss, damage, delay or inconvenience arising from a guest’s stay or participation in any activity.
Kuganha accepts no responsibility for the loss of, theft of or damage to personal belongings, valuables, vehicles or other property brought onto the reserve.
To the fullest extent permitted by law, Kuganha shall not be liable for any indirect, consequential or incidental losses arising from a reservation, stay or experience.
Force majeure
Kuganha regrets that we cannot accept liability or pay compensation where the performance or proper performance of our obligations is prevented or affected by any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid.
Such events include dread disease shutdown (as a pandemic), war or threat of war, riots, civil strife, border closures, unexpected government acts, terrorist activity, industrials disputes, natural or nuclear disaster, extreme weather conditions, fire and/or road closures and all similar events beyond our control.
Transfers
Luxury return road transfers are included in the overnight rates from Cape Town. Pick-up and drop-off is from any Cape Town location. Transfers are approximately 2.5 hours depending on the pick-up and drop-off location and time spent at the half-way restroom stop.
Helicopter transfers may be arranged at an additional cost and are subject to availability, weather conditions and aviation regulations.
Kuganha cannot be held responsible for delays resulting from weather conditions, road closures, traffic disruptions, mechanical issues or circumstances beyond its reasonable control.
Drone use
The use of drones is prohibited unless prior written approval has been obtained from management and all applicable aviation, conservation and safety regulations have been met.
Complaints
Complaints must be reported immediately to the General Manager, who will make every reasonable effort to resolve the matter during the stay.
Should a concern remain unresolved, a written report should be submitted to the Aquila Collection within seven (7) days of departure to allow for a full investigation.
Liability cannot be accepted for complaints not reported in accordance with this procedure.
Acknowledgement of risk
By confirming a reservation and staying at Kuganha, guests acknowledge the inherent risks associated with wildlife environments, outdoor activities and restoration facilities, and accept participation in such experiences with full awareness of those risks.
Applicable law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
